1. About us

GigaGizmo is an online store operating from Australia. The Site offers consumer products including gadgets, mobility aids, recovery devices and toys.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By ordering you confirm that the information you provide is accurate and current.

3. Products and pricing

We try to display product photos, descriptions and prices as accurately as possible. Colours, dimensions and packaging may vary slightly from what is shown on screen. Prices are in Australian dollars (AUD) and include applicable GST unless stated otherwise.

We reserve the right to correct pricing or description errors and to refuse or cancel an order in these cases, including after an order has been placed. If we cancel due to a pricing error, we will refund any amount paid.

4. Orders and acceptance

An order is an offer to buy. Acceptance happens when we dispatch the goods or send a confirmation that the order has shipped. Until then we may decline or cancel an order — for example because of stock, suspected fraud or address issues — and refund any amount charged.

5. Payment

Payments are processed by Shopify Payments and supported wallets (Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay and Shop Pay). You authorise us to charge your selected method for the full order amount, including any taxes and shipping where applicable.

6. Shipping, returns and refunds

Shipping is free across Australia and is governed by our Shipping policy. Returns are governed by our Returns policy and refunds by our Refund policy. These documents form part of these terms.

7. Use of the Site

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to interfere with the Site's normal operation; (c) reverse engineer, scrape, or copy substantial parts of the Site or its content; or (d) use the Site to transmit malware or harmful code.

8. Intellectual property

The GigaGizmo name, logo, store layout, photographs, copy and code on the Site are owned by GigaGizmo or its licensors and are protected by copyright and trademark law. You may not copy, modify, distribute or reproduce them without prior written permission, except for personal, non-commercial browsing.

9. User content

If you submit reviews, photos, comments or other content to the Site, you grant GigaGizmo a non-exclusive, royalty-free, worldwide licence to use, display, reproduce and distribute that content in connection with the Site and our marketing.

10. Disclaimers

The Site and its content are provided “as is”. While we take care to keep the Site accurate and available, we don't warrant that it will be uninterrupted, error-free or that defects will be corrected immediately. Product information is for general guidance — please follow the manufacturer's instructions and warnings included with each product.

11. Limitation of liability

To the maximum extent permitted by law, GigaGizmo's total liability for any claim arising from your use of the Site or any product purchased through it is limited to the amount you paid for the relevant order. Nothing in these terms limits liability that cannot be limited under the Australian Consumer Law.

12. Changes to these terms

We may update these terms from time to time. The current version is always posted on this page with the “last updated” date below. Continued use of the Site after changes are posted means you accept the updated terms.

13. Governing law

These terms are governed by the laws of Australia. You agree to the exclusive jurisdiction of the courts located in Australia for any dispute that cannot be resolved informally.
